How can it be guaranteed that the data I register on the NAP ITS will not be misused? (For example for cut-through traffic)

The Delegated Regulation (EU)2017/1926 states that the data registered on the NAP ITS should be reused in a neutral way, without discrimination or bias. If data from e.g. transport operators is used by travel information service providers to propose various travel options, the criteria for ranking should be transparent and the representation of the main travel route should not be misleading for the end user.

Specifically with respect to cut-through traffic, the Delegated Regulation (EU) 2015/962 for Real Time Traffic Information (RTTI) states that if service providers use road data provided by road authorities and road operators, they must take into account, to the extent possible, traffic circulation plans (and traffic management plans) prepared by the competent authorities.

A data owner may also impose conditions for (re)use of the data in a license agreement as long as these conditions do not unnecessarily restrict the possibilities for reuse and that any financial compensation is reasonable and proportionate to the legitimate costs of providing and disseminating these data.
